The use of this website (“site”) is governed by the policies, terms and conditions set forth below which constitute an agreement between users of the site (“you”, “your”) and Saffron Slipper Company ("we", "us"). Please read them carefully. Your use of this site indicates your acceptance of these terms and conditions, together with the documents referred to on it. Your placement of an order indicates your acceptance of these terms and conditions. These terms and conditions shall supersede any subsequent terms or conditions included with any purchase order, whether or not such terms or conditions are signed by us. We reserve the right to make changes to this site and these terms and conditions at any time. If You do not agree to be bound by these terms and conditions, you may not use or access this website.

REGISTRATION

To use some of the services or features made available to you on this Site, you will need to register. When you register, you are required to provide information about yourself that is true, accurate, current, and complete in all respects. Should any of your registration information change, please notify us immediately. We may also change registration requirements from time to time. Please refer to our Privacy Policy for information about how we use your data.

ELIGIBILITY

In order to make purchases on the site, you will be required to provide your personal details. In particular, you must provide your real name, phone number, e-mail address and other requested information as indicated. Furthermore, you will be required to provide payment details that you represent and warrant, are both valid and correct and you confirm that you are the person referred to in the Billing information provided. The site is available only to individuals and others who meet the terms of eligibility, who have been issued a valid credit/debit card by a bank acceptable to us. By making an offer to purchase merchandise, you expressly authorise us to share information about you and your transaction with other companies for the propose of processing your transaction and performing credit checks. Furthermore, you agree that we may use Personal information provided by you in order to conduct appropriate anti-fraud checks. Personal Information that you provide may be disclosed to a credit reference or fraud prevention agency, which may keep a record of that information.

ORDERS

All orders are subject to acceptance and availability, and items in your shopping basket are not reserved and may be purchased by other customers.

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update Your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

PRICING

The prices of Goods, delivery and other charges displayed on this site are current at the time of issue, however, we reserve the right to change prices at any time before we accept an order from you.

All prices shown on this site are in Australian Dollars (AUD).

We will charge you, and you agree to pay, the following fees and charges in relation to an order that We accept (as applicable):

- the purchase price of each Good that is ordered;

- the delivery fee for delivering the Goods to You; and

- any other fees and charges set out in these Terms.

All fees and charges identified in these Terms and all prices for the Goods as shown on the site are inclusive of GST (unless otherwise indicated). If you are a customer whose credit/debit card is not denominated in displayed currency, the final price will be calculated in accordance with the applicable exchange rate on the day your card issuer processes the transaction.

AVAILABILITY

All orders are subject to the availability of the Product. If for any reason a Product is not available, we will endeavour to notify the non-availability on our site. Occasionally, if items are very popular, they will sell out very quickly. In this case, you will be contacted within 48 hours if We are unable to fill Your order and a full refund will be processed.

DELIVERY

The delivery times provided by us are estimates only. We aim to deliver within the time indicated by us at the place of delivery requested by you. We cannot guarantee delivery dates and we shall not be liable to You for any losses, liabilities, costs, damages, charges or expenses arising out of late delivery. Please note that it might not be possible for us to deliver to some locations. If this is the case, we will inform You using the contact details that you provide to us when you make your order and arrange for cancellation of the order or delivery to an alternative delivery address. In the event that multiple items are ordered, part deliveries may be made where stock is not available. All reasonable attempts to notify you will be made using the details you provided.

On delivery of the Product, you may be required to sign for delivery, unless you grant us to leave (“ATL”). If you grant ATL, you understand and agree that this authority to leave gives us and/or our selected couriers permission to leave the order in question unattended by the front door – or, where applicable, at the reception or concierge’s desk – of the delivery address without obtaining a signature confirming delivery at the delivery location. In such circumstances, you understand and agree that by granting us authority to leave, We and our couriers are released of all responsibility and liability for the orders delivered and left unattended, and that this responsibility and liability transfer to you on delivery. If You are not available to take delivery or collection, the delivery partners may leave a card giving you instructions on either re- delivery or collection from the carrier.

CHANGE OF ADDRESS

We cannot be held responsible for an incorrect address being entered on your order. Address confirmation is given on the review page in the checkout section of the site. If this is not noticed until after your order is finalised, please contact us immediately. We will attempt to update any incorrect order details. However, some orders cannot be adjusted in the delivery stage. Therefore, you should carefully check that your order is accurate before you submit it to us.

COLOURS

We have made every effort to display as accurately as possible the colours of our products that appear on site. However, as computer monitors vary, we cannot guarantee that your monitor's display of any colour will be completely accurate.

ERRORS, INACCURACIES AND OMISSIONS

Occasionally there may be information on our site that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information on our site is inaccurate at any time without prior notice (including after You have submitted your order).

This site may contain links to other sites on the Internet that are owned and operated by third parties. You acknowledge that we are not responsible for the operation of or content located on or through any such site and is not liable for any losses or damage caused by this website or any website linked to or from this website.

NO COMMERCIAL USE

This Site is for your personal non-commercial use only. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, commercially exploit, create derivative works from, transfer, or sell any content, software, products, or services contained within this Site. You may not use this Site, or any of its content, to further any commercial purpose, including any advertising or advertising revenue generation activity on your own Site.

WARRANTY AND LIMITIATION OF LIABILITY

We accept Liability for all legal guarantees and warranties expressed or implied to the transactions under the Australian Consumer Law in Schedule 2 of the Competition and Consumer Act 2010 (Cth), or any other legislation (such as the Fair Trading Acts (or equivalent legislation) in each State and Territory) the effect of which cannot be excluded.

You acknowledge and agree that use of this Site is at your sole risk. Where we are permitted by law:

- we do not warrant or represent the suitability of the Site or any Goods for any purpose; and

- we will not be liable to you for indirect and consequential loss (including without limitation for loss of revenue, loss of profits, failure to realise expected profits or savings and any other commercial or economic loss of any kind) or loss or corruption of data, in contract, tort, under any statute or otherwise (including negligence) arising from or connected to the Site or the Goods.

To the fullest extent permitted by law, Saffron Slipper Company, its related bodies corporate and their officers, employees, agents and contractors disclaims all warranties of any kind (whether express or implied) in relation to the site and the material and will not be liable for any direct or indirect damage (including special and/or consequential damage, such as loss of business, loss of profits or loss of data) which results from any use or access of, or any inability to use or access the site or the material even if Saffron Slipper Company was made aware of the possibility of such damages.

Our Liability to you for loss or damage of any kind arising out of these Terms or in connection with the relationship established by them is reduced to the extent (if any) that you cause or contribute to the loss or damage. This reduction applies whether our Liability is in contract, tort (including negligence), under any statute or otherwise.

INDEMNITY

You agree to indemnify us from and against all claims, actions, liabilities, costs and expenses (including legal costs on a full indemnity basis) resulting from your failure to comply with these Terms.

RETURNS & EXCHANGES

Unless you notify us within fourteen (14) days of receiving of any Goods and such notification is confirmed by return email by Saffron Slipper Company, the Goods shall be deemed to have been accepted by you. Please see Returns & Exchanges on the Site for more information on our Return Policy.

We may collect your information (including personal information) via your use of the site and/or purchase of Goods. Refer to the Privacy Policy, which form part of these Terms.

INTELLECTUAL PROPERTY

This site is owned by Saffron Slipper Company. Unless otherwise specified, all materials appearing on this site, including the text, site design, logos, graphics, icons, and images, as well as the selection, assembly and arrangement thereof, are the sole property of or used under license by us. The intellectual property rights in all software and content made available to you on or through this site remain our property or that of our licensors and are protected by intellectual property laws and treaties around the world. All such rights are reserved by us and our licensors. You may store, print and display the content supplied solely for your own personal use. You are not permitted to publish, manipulate, distribute or otherwise reproduce, in any format, any of the content or copies of the content supplied to you or which appears on this site nor may you use any such content in connection with any business or commercial enterprise. All rights not expressly granted herein are reserved. The Terms and Conditions which apply at the time of Order are those that govern Your relationship with us with respect to that Order. If the whole or any part of a provision of these Terms are void, unenforceable or illegal in a jurisdiction it is severed for that jurisdiction. The remainder of these Terms have full force and effect and the validity or enforceability of that provision in any other jurisdiction is not affected. This clause has no effect if the severance alters the basic nature of these Terms or is contrary to public policy. These Terms & Conditions are governed by the laws of the State of Western Australia. Each party submits to the non-exclusive jurisdiction of the courts of that place.
